Una critica intersezionale di genere alla Direttiva europea sulle piattaforme digitali

Abstract

La direttiva sul miglioramento delle condizioni di lavoro nel lavoro su piattaforma sfida le disuguaglianze profondamente radicate nel lavoro su piattaforma, regolando alcuni aspetti del processo lavorativo che nella maggior parte degli Stati membri dell'UE attualmente non sono regolati. La direttiva è il risultato delle lotte sindacali e delle cause giudiziarie che si sono svolte negli ultimi anni contro l'errata classificazione dei lavoratori delle piattaforme come lavoratori autonomi indipendenti e l'uso non trasparente degli algoritmi nella gestione delle risorse umane. Tuttavia, la direttiva è cieca rispetto al genere e oscura gli aspetti intersettoriali della gestione algoritmica. Nel testo, ci sono pochi riferimenti al “genere” o alle “donne” e questioni importanti come l'equilibrio tra vita privata e lavoro, la parità di retribuzione a parità di lavoro, le molestie sessuali, la discriminazione intersezionale di genere o i congedi retribuiti di maternità e paternità sono menzionati ma non considerati. Sulla base della letteratura in materia, l'articolo esplora le sfide di genere che emergeranno dalla sua attuazione, in particolare per quanto riguarda il lavoro riproduttivo e i pregiudizi algoritmici. Più specificamente, l'analisi utilizza la ricerca esistente sulle disuguaglianze intersezionali di genere in diverse aree del lavoro su piattaforma, principalmente il crowdwork e il lavoro domestico e di cura, per esplorare l'impatto che avrà sull'economia su piattaforma. Il contributo conclude sostenendo che il fatto che la direttiva oscuri le forme specifiche che la disuguaglianza di genere assume nelle piattaforme esaspererà ulteriormente le disuguaglianze di genere intersezionali e la discriminazione nel lavoro su piattaforma.
