¿Subordinación o sujection? Un estudio sobre la línea divisoria entre el empleo y el trabajo por cuenta propia en seis sistemas jurídicos europeos

Resumen

Este artículo presenta un análisis comparativo de seis países (Francia, Alemania, Italia, Eslovaquia, los Países Bajos y el Reino Unido) que tiene como objetivo examinar la distinción entre el trabajo subordinado y el trabajo por cuenta propia. Asimismo, el artículo investiga los principales criterios utilizado por la ley y los jueces para identificar los dos conceptos en cada uno de los países mencionados y también describe cómo algunos sistemas juridicos han configurado un tercer género distinto a los señalados. Este artículo proporciona una base uniforme para las discusiones y una evaluación crítica de los diversos enfoques que estos sistemas legales han elegido para dar forma al concepto de contrato de trabajo / trabajo subordinado u otros conceptos juridicos que garanticen la protección. En la parte final, se extraen algunas conclusiones sobre los países estudiados, y se introduce el nuevo concepto de 'sujeción' para reorganizar la protección otorgada por la legislación laboral. De hecho, este último puede adaptarse mejor al escenario socioeconómico actual y absorbe y expande el concepto de subordinación. El escenario socioeconómico se describe en la primera parte del artículo. Por último, el estudio subraya la necesidad de proteger a los autónomos genuinos a través de mecanismos para garantizar la protección social en casos de enfermedad, impedimentos a trabajar a largo plazo y la pensión adecuada.
