Resumen

Australia está a punto de unirse a varias jurisdicciones internacionales mediante la aplicación de su propio derecho legal a la desconexión el 26 de agosto de 2024 para la mayoría de los empleados (o el 26 de agosto de 2025 para los que trabajan en pequeñas empresas). Este artículo presenta el nuevo derecho a la desconexión en Australia. Explica dónde se sitúa el derecho en el contexto más amplio del sistema de legislación laboral de Australia. Se traza el rápido desarrollo legislativo del derecho, junto con su funcionamiento propuesto en virtud de la legislación laboral clave de Australia, la Fair Work Act 2009 (Cth).
