Associazionismo datoriale e dialogo sociale: cronache di uno stallo annunciato?

Abstract

Il saggio si sofferma su ruolo e funzioni delle organizzazioni datoriali a livello sovranazionale.

A partire da una ricostruzione della cornice promozionale di regolazione del dialogo sociale europeo, il contributo analizza la nozione di rappresentatività datoriale emergente a livello sovranazionale.

Il concetto di “rappresentatività europea” è indagato, in particolare, con riferimento ai criteri di misurazione del peso rappresentativo (sindacale e datoriale) elaborati dalla Commissione europea fin dalle Comunicazioni degli anni ’90 sul tema – successivamente precisati da una pronuncia del Tribunale di prima istanza dell’Ue e progressivamente affinati dagli studi commissionati a Eurofound – e alla loro sostanziale inadeguatezza a fronteggiare il fenomeno della frammentazione della rappresentanza degli interessi imprenditoriali.

Il tema della frammentazione rappresentativa datoriale è poi espressamente declinato nel contesto del dialogo sociale settoriale, nel quale assume, insieme ad altri fattori destrutturanti, un ruolo non irrilevante nella crisi del dialogo sociale sovranazionale. Nella parte conclusiva del lavoro, si formulano alcune riflessioni sulle (incerte) prospettive di rilancio del dialogo sociale europeo.
