Associazionismo datoriale e dialogo sociale: cronache di uno stallo annunciato?

El ensayo examina papel y funciones de las organizaciones patronales a nivel supranacional. A partir de una reconstrucción del marco promocional de regulación del diálogo social europeo, la contribución analiza la noción de representatividad patronal emergente a nivel supranacional.
El concepto de "representatividad europea" es indagado, en particular, con referencia a los criterios de medición del peso representativo (sindical y patronal) elaborados por la Comisión europea desde las Comunicaciones de los años' 90 sobre el tema - sucesivamente precisados por una pronunciación del Tribunal de primera instancia del Ue y progresivamente refinados por los estudios comisionados a Eurofound - y sobre la sustancial inadecuación de ellos a enfrentar el fenómeno de la fragmentación de la representación de los intereses empresariales.
El tema de la fragmentación representativa patronal es en fin expresamente declinado en el contexto del diálogo social sectorial, en el que asume, junto a otros factores desestructurantes, un papel no irrelevante en la crisis del diálogo social supranacional.
En la parte conclusiva del trabajo, se formulan algunas reflexiones sobre los, inciertas, perspectivas de reanudación del diálogo social europeo.
