Abstract

L’articolo analizza le modalità di accesso alla giustizia per i lavoratori dell'industria floricola keniota. Sulla base di un'indagine empirica - che include interviste con quattordici esperti del settore - alcune istituzioni sono state considerate rilevanti al fine di consentire l’accesso alla giustizia: l'istituto nazionale dei diritti umani, gli uffici del lavoro del Ministero del Lavoro e della Protezione Sociale e i Tribunali. Pur tenendo presente che alcuni aspetti sono una conseguenza della posizione del Kenya all'interno della più ampia economia politica internazionale, l’articolo intende approfondire quali siano le barriere per l'accesso alla tutela giudiziaria e illustrare come gli interessi delle élite politiche ed economiche rischino di ridurre l’adeguatezza dei rimedi.
