El trabajo entre el derecho y la economía: de la economía digital al Derecho romano

Resumen

La economía digital ha impulsado el rápido desarrollo del trabajo en plataformas, mientras que el marco regulatorio tradicional del derecho laboral ha ido mostrando progresivamente deficiencias tanto en su ámbito de cobertura como en su capacidad interpretativa. La gobernanza algorítmica y los mecanismos institucionales de deslaboralización de la relación de trabajo han situado a un gran número de trabajadores en una zona gris entre el derecho laboral y el derecho civil, dando lugar a una protección fragmentada de sus derechos.

Las normas relativas al trabajo en el Derecho romano no partían de la identidad del trabajador, sino que se centraban en el hecho social de la prestación de servicios. Mediante diferentes tipos contractuales, el Derecho romano distinguía el proceso de trabajo del resultado del trabajo, asignando en consecuencia los derechos y las obligaciones. Esta lógica institucional ofrece una nueva perspectiva para replantear la legislación laboral china en el contexto de la economía digital. Las normas laborales no tienen por qué tomar el reconocimiento de la condición de trabajador como único presupuesto; por el contrario, deberían pasar de un enfoque basado en la identidad a otro basado en la prestación de servicios, respondiendo a la evolución diversificada de las formas de trabajo mediante una valoración multifactorial y una regulación diferenciada.
