Abstract

L'economia digitale ha favorito il rapido sviluppo del lavoro tramite piattaforme, mentre il tradizionale quadro normativo del diritto del lavoro ha progressivamente mostrato carenze in termini di copertura e capacità interpretativa. La governance algoritmica e gli assetti istituzionali della de-lavorizzazione del rapporto di lavoro hanno collocato un gran numero di lavoratori in un'area grigia tra il diritto del lavoro e il diritto civile, determinando una tutela dei loro diritti frammentata. Le norme relative al lavoro nel diritto romano non prendevano le mosse dallo status del lavoratore, bensì si fondavano sul fatto sociale della prestazione di servizi. Attraverso diverse tipologie contrattuali, il diritto romano distingueva il processo lavorativo dal risultato del lavoro, distribuendo di conseguenza diritti e obblighi. Questa logica istituzionale offre una nuova prospettiva per ripensare la legislazione cinese sul lavoro nel contesto dell'economia digitale. Le norme lavoristiche non devono necessariamente assumere il riconoscimento dello status del lavoratore come unico presupposto; al contrario, dovrebbero passare da un approccio basato sull'identità a uno fondato sulla prestazione di servizi, rispondendo all'evoluzione diversificata delle forme di lavoro attraverso una valutazione multifattoriale e una regolazione differenziata.
