Il lavoro nella on-demand economy: esigenze di tutela e prospettive regolatorie

Resumen

El ensayo tiene a objeto la temática del cd. on-demand economy ― o bien de aquel modelo económico que se basa en el empleo de plataformas online que permiten el inmediato matching entre un usuario que solicita un bien o un servicio y otro que está capaz de proveerlo "compartiendo" el patrimonio de bienes, competencias, tiempo de que está en posesión ― con específica referencia al derecho del trabajo.

A través de un análisis del modelo económico, de las características y condiciones de los trabajadores implicados y el contexto normativo de referencia, el A. se concentra en las exigencias de tutela de la fuerzas ocupada sobre la plataforma.

Después de una análisis general de la temática, la contribución focaliza la atención sobre las consecuencias de tal modelo económico, que se caracteriza por el status de trabajador autónomo del prestador y intermediario por la sociedad que administra la plataforma.

Son localizados, en particular, tres nudos fundamentales sobre que analizar las exigencias de tutela de los trabajadores: seguridad económica; reputación y formación.

En las conclusiones de la contribución, el A.., subrayada la necesidad de una intervención legislativa para disciplinal un fenómeno que siempre va adquiriendo mayor relieve en los muchos contextos nacionales, ofrece una panorámica de las posibles modalidades, objeto de discusión entre los comentadores, en cuyo tal intervención podría ocurrir.
